General information

  1. Berefijn is a brand of Fun-Events Bvba. All Berefijn mentions below are the responsibility of Fun-Events Bvba.
  2. The indication of price only refers to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
  3. Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Fun-Events Bvba and the correctness and completeness of the information offered is only bound to an obligation of means. Fun-Events Bvba is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.
  4. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.
  5. You chose to have your teddy bear filled by Berefijn. We fill each teddy bear to their own ability. Each teddy bear has a different filling capacity and therefore cannot be compared with another teddy bear that is not of the same type of teddy bear. Berefijn does not enter into a discussion about the amount of filling, we stick to the possibilities of the teddy bear you chose. Berefijn can therefore not be held responsible if you are of the opinion that the teddy bear is not filled enough or too much.
  6. The offer is always valid while stocks last and can be adjusted or withdrawn by Berefijn at any time. Fun-Events Bvba cannot be held liable for the unavailability of a product.

Terms and Conditions

  1. All general terms and conditions apply to all information, offers, texts, photos, promotions, … of Berefijn, unless otherwise agreed, although confirmed in writing by Berefijn.
  2. Orders can only be made by completing the order form, online account, by e-mail with full details and form in our shop.
  3. When placing an order, the customer / buyer agrees to all our terms and conditions.
  4. We ask for a minimum order amount, if customer / purchaser orders below the minimum order amount, Berefijn is entitled to charge a surcharge.
  5. For online orders and by e-mail we always ask for a full payment in advance, as long as this has not been paid, there is no definitive agreement / order and the ordered product remains the property of Berefijn.
  6. If a specific item is no longer available / in stock, Berefijn will offer you a possible alternative via other suggestions.
  7. If an article is no longer available / in stock, Berefijn will keep you informed about the relevant article whether it can still be offered and within what period.
  8. An incorrect stock management cannot be charged to Berefijn in order to receive compensation, Berefijn will in this case fully or partially refund the order in agreement with the customer / buyer. Berefijn provides you with complete information about the specific item and within which period it will be available / delivered / picked up again or not.
  9. The agreement of an order is only final after Berefijn has received and accepted everything.
  10. Prices online are current, prices in mailing, printed matter or others may deviate due to price changes.
  11. As long as no definitive agreement / payment has been agreed / received, Berefijn is authorized to implement price changes.
  12. Berefijn is authorized to make price changes to any sales tax and other taxes, duties and levies, which will be passed on to the customer / purchaser.
  13. All prices include VAT.
  14. All prices exclude transport, shipping and other legal contributions unless stated otherwise.
  15. Discounted items cannot be returned to us.
  16. Depending on the payment method, Berefijn is authorized to charge costs to the customer / purchaser.
  17. Berefijn determines the modes of transport, dispatch, transport. If the customer / purchaser has other transport wishes, the additional costs will be charged to the customer / purchaser.
  18. Berefijn cannot be charged with the late delivery of the order by the carrier / transporter. You will be notified when your order has actually left Berefijn and is on its way.
  19. Berefijn is entitled to deliver part of the order, there are no additional costs associated with subsequent delivery.
  20. Berefijn handles your order with all concerns, it can always happen that an order is not delivered or is incomplete, you must inform us within 2 days.
  21. If the delivery is damaged, you must notify the carrier / transporter of this and you are entitled not to accept the delivery. If you nevertheless accept / tackle this, you are just more entitled, you accept the damage to your delivery.
  22. If the package is not damaged but an item in the package is damaged, you must inform us within 12 hours with the necessary information and evidence / photo material.
  23. If your item is damaged / does not meet your requirements and you do not report this to us within 12 hours of receipt, we can no longer accept this. Not everyone is equally careful with our products.
  24. If the address provided is incorrect or incomplete, Berefijn cannot be held responsible for not delivering / receiving the order. This is also valid for not picking up a package at the post office. If the package needs to be resent by us, the costs for this will be charged to the customer / purchaser.
  25. Payments can be made both online and via Bancontact, cash payment is also possible.
  26. If agreed to be paid on account by invoice, a payment term of 15 days after the invoice date applies.
  27. Failure to comply with the payment term will incur costs to the account of the customer / purchaser with a direct cost of 75 euros and 10 euros per day exceeded.
  28. In the event of disputes, a collection will be sent in the first instance and if there is no consequence, the outstanding balance will be claimed by judicial means, the customer / purchaser is responsible for all costs thereof.
  29. In the event of a non-agreed payment method, Berefijn has the right to inform the customer / purchaser that the order will be sent after payment in advance and receipt thereof.
  30. All articles remain the property of Berefijn as long as payment for all articles thereof has not been made, in accordance with the law on retention of title.
  31. Berefijn is authorized to reclaim this property without having to initiate a notice of default.
  32. All data that is stored in our customer database to process orders and purchases is only used by Berefijn and therefore Fun-Events Bvba. We apply the legislation on the use of personal data.
  33. Berefijn cannot be held responsible for incorrect images, information, printing errors, technical data and other by suppliers and products. As well as the unforeseeable quality of the products and suppliers. All images and other information provide the best possible picture of the product, but deviations are possible.
  34. Berefijn is only liable for the paid product that has actually been purchased and is provable.
  35. All information about Berefijn general terms and conditions can be consulted via our webshop / General terms and conditions and these apply to every visit and purchase both via the online webshop and the store. Any customer / purchaser can request and print these if desired.
  36. Berefijn makes all information available that applies to the sale of the materials offered and all data that applies to this.
  37. If you, as a customer / purchaser, wish to renounce the agreement / purchase and the dissolution and destruction thereof on the basis of non-compliance by Berefijn of the legal information, this must be done within 2 days after purchase / agreement.
  38. Under the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
  39. To invoke the warranty, the customer / purchaser must be able to present proof of purchase. Customers / buyers are advised to keep the original packaging of the goods.
  40. For the articles that have been purchased and delivered online, the customer / purchaser must always contact Berefijn and return the articles to Berefijn at his expense.
  41. When a defect is established, the customer / purchaser must inform Berefijn as soon as possible. In any case, any defect must be reported by the customer / purchaser within a period of 12 hours after it has been established. Afterwards, any right to repair or replacement lapses.
  42. The (commercial and / or legal) guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
  43. Defects that manifest themselves after commissioning the products. In a period of 1 week following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless proof to the contrary by the customer / purchaser.
  44. Products that show defects or damage must first be reported to Berefijn via info@berefijn.be with the necessary supporting documents. Products of which Berefijn is not aware that are returned will not be accepted.
  45. If you are allowed to return your products with Berefijn’s permission, Berefijn will subject them to a thorough check/test. If it appears that Berefijn cannot be held responsible for this, your product will be returned to the relevant supplier.
  46. Authorized supplier will also perform tests/checks on this product as soon as this product arrives at their disposal. They will make a decision that will be reported to Berefijn. This can sometimes take several weeks, as long as Berefijn does not receive an answer from its supplier, Berefijn cannot make a decision/refund to the customer/buyer.
  47. If damaged/defective products are no longer available due to stock problems or the end of the range of suppliers, Berefijn will discuss further with the customer/buyer.
  48. Disputes are resolved by mutual agreement wherever possible.
  49. These general terms and conditions are governed by Belgian law and all disputes will be handled by the court on the basis of the registered office of Berefijn.
  50. Complaints are handled by Berefijn in a complaints procedure, which is known by the customer / purchaser and is in accordance with the conditions
  51. All complaints are noted and clearly described by Berefijn after the customer / purchaser has established them.
  52. Berefijn will answer your complaint within 7 days. If a complaint unforeseenly needs a longer time to process, we will keep the customer / buyer informed of this.
  53. If a complaint cannot be resolved mutually and a dispute remains, the dispute settlement / procedure will be started.
  54. If a validity / best before date applies to an article, this will also be stated.
  55. The customer / purchaser is aware of all information regarding our offer and our working method, conditions, such that it is clear to each customer / purchaser about the rights and obligations for accepting our offer and the commitment thereof.
